This Privacy Policy (“Policy”) describes Serving Up Change’s information collection and sharing practices for individual users of our online services (“you” or “User”) and how you can manage your personal information stored with us. This Privacy Policy is effective as of April 1, 2017. This policy applies to our websites, mobile applications, email, text messages and social media accounts (“Platforms”).

By clicking “Accept” or by using the Platforms, you accept and consent to the collection, use, sharing, disclosure, storage, transfer and processing of your information as described in this policy. Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with this policy, please do not use the Platforms.

Information We Collect

We automatically collect some information about your computer or mobile device when you visit the Platforms. For example, we may collect information about your IP address, web browser, Internet Service Providers (ISPs), referring and exit pages, operating systems, date/time stamps, etc. (“Non-Identifying Information”). This information is used to administer the Platforms, track User movements and gather information about referring websites. We may also collect information about your online activity, such as fundraisers viewed. This automatic information is used only on an aggregated, anonymous basis and is not used with, or linked to, any personally identifiable information (“Personal Information”).

We receive Personal Information from you when you register for an account on the Platforms, place an order or arrange services on our Platforms, open or respond to our e-mails, visit any page that displays our ads or content, connect or link to any Platform via social networking sites, post comments to online communities and/or provide information to our suppliers, advertisers, and business partners. Personal Information collected may include first and last name, postal and e-mail addresses, phone number, and billing information. You may choose not to provide Personal Information to us, but, in general, some Personal Information about you is required for you to register for an account, purchase electronic gift cards (“e-Gift Cards”), ask us a question, or initiate other transactions on the Platforms.

How We Use Your Information

Serving Up Changes uses Personal Information and Non-Identifying Information it collects to:

  • Manage and develop our business and operations;

  • Establish, manage and terminate business relations with you;

  • Provide the products or services you have chosen;

  • Help participating businesses and organizations honor donations you have made;

  • Notify you about fundraisers that may be of interest to you;

  • Provide information about related products and services that may be of interest to you;

  • Respond to your comments or requests for information;

  • Protect us against error, fraud, theft and damage to our goods and property;

  • Enable us to comply with applicable law or regulatory requirements;

  • Conform with the requirements of the law or to comply with legal process served on us;

  • Protect our legal rights or property or other customers; and

  • Assist us in delivering relevant ads when you visit the Platforms.

We use Non-Identifying Information in a variety of ways, including to help analyze Platform traffic, understand customer needs and trends, and to improve our products and services as well as for marketing purposes, such as carrying out targeted promotional activities and interest-based advertising.

How We Share Your Information

With Participating Businesses and Fundraising Organizations. When you sign up for a fundraiser or purchase a gift card, we share your Personal Information with the business where the fundraiser will be held. In addition, we may share some Personal Information with the organization that is hosting the fundraiser. These organizations have agreed to abide by the terms of this Policy for the purposes of organizing fundraisers through Serving Up Change, and they have agreed not to sell, rent, or transfer to others the Personal Information you submit to us. Please note, however, that we cannot control the privacy practices of Participating Businesses and Participating Organizations. We encourage you to review the privacy policies of specific businesses and organizations for more information regarding applicable privacy practices. Serving Up Change assumes no liability or responsibility for breach of this Policy by any Participating Business or Participating Organization.

Third Party Vendors. We share your information with third party vendors who provide services or functions on our behalf. These third party vendors include our payment processing vendor and advertising and business partners. Please note that all credit card information is stored and processed by a reputable third-party credit card processing vendor, which is obligated to comply with payment card industry standards. We may also authorize third party vendors to collect information on our behalf as necessary to operate features of our Platforms or to facilitate online advertising tailored to your interests. Third-party vendors have access to, and may collect, your Personal Information to perform their functions and deliver services. These companies are not authorized to sell, rent, or transfer your Personal Information to others.

Future Business Transactions. As our business is constantly changing, we may transfer your Personal Information as part of a merger, sale of assets, acquisition, etc. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and may be sold or transferred to third parties to the extent permitted by applicable law.

Legal Authorities. We may disclose any Personal Information or Non-Identifying Information about you if we are required to do so by law, or if we believe that such action is necessary to: (1) fulfill a government request; (2) conform with the requirements of the law or legal process; (3) protect or defend our legal rights or property, including the Platforms; or (4) in an emergency to protect the health and safety of the Platform’s Users or the general public.

Children Under the Age of 13

Our Platforms are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Platforms. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Platforms or on or through any of their features, register on the Platforms, use any of the interactive features of the Platforms or provide any information about yourself to us. If we learn that we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. We collect certain information using automated means, such as cookies, when you visit the Platforms. A “cookie” is a text file placed on a computer’s hard drive by a web server. Protecting Your Information

We want you to feel confident about using our Platforms to register with us and use our services. We are committed to protecting the Personal Information we collect. While no Platform can guarantee security, we use commercially reasonable physical, technical and administrative safeguards to assist us in preventing unauthorized access, use and disclosure of your Personal Information.

Linked Sites

Our Platforms may contain links to other websites operated by third parties, including participating businesses and fundraising organizations. This Policy does not apply to your use of third party websites. Serving Up Change is not responsible for the information practices or content on such linked sites, including the sites belonging to Participating Businesses and Participating Organizations, and your use of those third parties’ sites is not governed by this Policy. We have no liability or responsibility for those sites or their privacy policies and practices. We recommend that you carefully read the policies, including terms and conditions of use, of each site you visit.

E-mail Notifications

To respect the privacy of our users, we provide the opportunity to opt out of certain types of communication. You may choose not to receive commercial e-mails from us by following the unsubscribe instructions contained in the e-mails. Please note that even if you unsubscribe from commercial e-mail messages, we may still e-mail you regarding your account and your transactions.

If you wish to opt out of receiving offers from us, you can follow the opt-out or unsubscribe instructions in the e-mails that they send you. Please allow up to ten (10) business days for us to process this request.

If you wish to opt out of receiving marketing materials from Participating Businesses for which you have purchased e-Gift Cards, you can uncheck the appropriate box in our online payment form, and we will request that the applicable Participating Business not use your Personal Information for marketing purposes. However, please note that Serving Up Change cannot control the privacy practices of Participating Businesses, and Serving Up Change assumes no liability or responsibility for any Participating Business’s breach of this Policy.

Managing “Do Not Track” Signals

Some browsers have a Do Not Track (“DNT”) feature that lets you tell websites that you do not want your online activities tracked. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, ad networks, plug-in providers, and other web services you encounter while browsing to stop tracking your activity via cookies or other tracking technologies. Our Platforms do not respond to DNT signals at this time.

California Residents

If you are a California resident and have an established business relationship with us (for example, if you have ordered from us or have a login account), you can request a notice disclosing the categories of personal information we have shared with third parties, for the third parties’ direct marketing purposes, during the preceding calendar year. To request such a notice, please submit your request to us at the mailing address noted below. Please allow 30 days for a response to your request.

If you are a California resident under 18 years old and have an account with us or have linked to us through social media, you can request that we remove content or information that you have posted to our website or other online services. Note that fulfilment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user). Changes to this Privacy Policy

Serving Up Change may from time to time make changes to this Policy to reflect changes in legal or regulatory obligations or changes in the manner in which we deal with Personal Information. We will post any revised version of this Policy on the Platforms. Any changes will be effective on the effective date stated in the revised Policy. If we significantly change how we handle your Personal Information, we may provide more prominent notice or obtain your consent as required by law. If you do not wish to accept the changes, you should cease using the Platforms. Your continued use of the Platforms after we have posted a revised Policy indicates your agreement to the revisions.
